Third-Party Services & Legal Compliance

1. Relationship with Namecheap

CANalitica provides certain services, including domain registration, hosting, SSL, and related website management, through its reseller relationship with Namecheap, Inc. (“Namecheap”). Where services are provisioned or managed through Namecheap, the client acknowledges and agrees that such services are subject to Namecheap’s policies, agreements, and service terms, in addition to CANalitica’s own terms.

2. Applicability of Namecheap Policies

Depending on the specific service, the following categories of Namecheap policies may apply:

  • Domains & Domain Privacy (e.g., Registration Agreements, ICANN policies, WHOIS Privacy)
  • Hosting Services (e.g., Hosting Terms of Service, Acceptable Use Policy, Email Terms, Uptime Guarantee)
  • SSL Certificates, PremiumDNS, SafeServe, and other Apps/Marketplace services
  • General & Universal Terms (e.g., Refund Policy, Court Order & Subpoena Policy, Privacy Notices, Data Processing Addendum, Universal Terms of Service)

3. Client Responsibilities

  • Clients are responsible for reviewing and complying with all applicable Namecheap agreements relevant to the services they use through CANalitica.
  • Failure to comply with Namecheap’s policies (including, but not limited to, acceptable use restrictions, dispute procedures, or payment obligations) may result in suspension or termination of services.
  • CANalitica disclaims responsibility for Namecheap’s independent policies, enforcement actions, or changes to their terms.

4. Third-Party Providers

Where CANalitica manages or supports services hosted outside Namecheap (e.g., with another registrar or hosting company chosen by the client), the client remains bound by that provider’s terms and policies. CANalitica is not liable for the service quality, uptime, or compliance obligations of third-party providers outside of Namecheap.

5. CANalitica’s Own Policies

This section applies only to services provisioned through Namecheap. Visitors to CANalitica’s website, and clients engaging CANalitica for design, consulting, or other services, remain subject to CANalitica’s own [Privacy Policy], [Cookie Policy], and [Terms of Service].
