CANalitica Professional Services Inc. Effective Date: July 29, 2026
These Terms of Use govern access to and use of the website canalitica.ca (the “Website”). They do not govern use of the CANalitica PMBI application itself.
If you have purchased or are using CANalitica PMBI (“PMBI”), your use of PMBI is governed by:
- The Microsoft Standard Contract, accepted at the time your organization places an Order through Microsoft Marketplace; and
- The PMBI Offering-Specific Terms, which supplement (and do not modify) the Standard Contract.
In the event of any conflict between this Website Terms of Use page and the documents above regarding use of PMBI, the Standard Contract and the PMBI Offering-Specific Terms control.

By accessing or using this Website, you accept and agree to be bound by these Terms of Use. If you do not agree, do not use this Website.
2. About This Website
This Website provides information about CANalitica and PMBI, including product information, downloadable resources (such as blank data templates and the PMBI User Guide), and a means of contacting us. It does not itself provide the PMBI Service — PMBI is accessed separately at app.canaliticapmbi.ca under the agreements described above.
3. Intellectual Property
All content on this Website — including text, graphics, logos, icons, images, and downloadable materials — is the property of CANalitica or its licensors and is protected by Canadian and international copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written permission, except that you may download and use the Excel data templates and PMBI User Guide for the purpose of evaluating or using PMBI.
4. Acceptable Use
In using this Website, you agree not to:
- Transmit any content that is unlawful, harmful, threatening, abusive, or otherwise objectionable;
- Attempt to gain unauthorized access to this Website, its underlying systems, or any connected network;
- Transmit viruses, malware, or other malicious code;
- Use automated means to scrape, crawl, or extract content from this Website in a manner that disrupts its operation;
- Violate any applicable law or the rights of any third party.

This Website may link to third-party sites, including Microsoft Marketplace and Microsoft documentation. We are not responsible for the content, accuracy, or practices of third-party sites, and linking to them does not imply endorsement.

While we try to keep it accurate and current, we do not warrant that it is complete, accurate, or up to date, and we may change it at any time without notice. Product-specific commitments regarding PMBI are made only in the Standard Contract, the PMBI Offering-Specific Terms, and any applicable Order — not in general Website content.
7. Limitation of Liability
To the fullest extent permitted by law, CANalitica is not liable for any damages arising from your use of, or inability to use, this Website or its content. This section does not apply to your use of the PMBI Offering itself, which is governed by the liability terms in the Standard Contract.
8. Governing Law
These Website Terms of Use are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. This section applies only to disputes about the Website; disputes about the PMBI Offering are governed by the applicable-law provisions of the Standard Contract.
9. Changes to These Terms
We may update these Terms of Use at any time by posting a revised version with a new Effective Date.
